glowbrook ApS is based in Aarhus, Denmark and is focused on the production and sales of premium smart water heating and circulation systems for private pools, spas, hot tubs, and decorative ponds. The website provides product and service information, example system configurations, and a way to request a quote or ask questions.

Any information on this website is general in nature and may not reflect the exact requirements of your site. System performance depends on variables such as water volume, cover usage, insulation, ambient temperature, wind exposure, pipe runs, filtration setup, and installation quality. A final recommendation usually requires additional information and, in some cases, an on-site assessment.

7. Limitation of liability

To the maximum extent permitted by law, glowbrook ApS will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, loss of revenue, loss of data, loss of goodwill, business interruption, or similar losses arising out of or related to your use of, or inability to use, the website.

To the extent glowbrook is found liable for direct damages arising out of or related to the website or these Terms, our aggregate liability will be limited to the amount paid by you to glowbrook for the website in the 12 months preceding the event giving rise to the claim, or EUR 100, whichever is lower. For avoidance of doubt, the website is generally provided without charge, and this cap may therefore be EUR 100.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including mandatory consumer rights where they apply, or liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

8. Indemnification

You agree to indemnify, defend, and hold harmless glowbrook ApS, its directors, officers, employees, and contractors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your misuse of the website.

These links are provided for convenience only. glowbrook does not control, endorse, or assume responsibility for third-party content, privacy practices, or terms. 11. Governing law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by the laws of Denmark, without regard to conflict of law principles.

Subject to the dispute resolution section below, the courts of Aarhus, Denmark will have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms, except where mandatory law provides otherwise.

12. Dispute resolution

Before initiating formal proceedings, you agree to contact glowbrook and attempt to resolve the issue informally. The informal resolution period is 30 days from the date you notify us in writing of the dispute. If the dispute is not resolved within the 30-day period, either party may pursue claims in the competent courts as set out under Governing law and jurisdiction, subject to any mandatory consumer protections that apply.

13. Termination

glowbrook may suspend or terminate your access to the website, with or without notice, if we reasonably believe you have violated these Terms, are attempting to compromise site security, or are using the site in a manner that could harm other users or glowbrook.

Sections that by their nature should survive termination will survive, including: Intellectual property, Disclaimer of warranties, Limitation of liability, Indemnification, Governing law, Dispute resolution, and Contact for legal notices.

14. Modifications

glowbrook may update these Terms from time to time to reflect changes in the website, legal requirements, or our business practices. Changes will be effective 14 days after they are posted on this page, unless a change is required by law to take effect sooner.
